EU finally funds its way to a unitary patent

A European Patent currently exists but it is validated in only 13 Member States and can cost up to Ђ18,000, of which nearly Ђ10,000 arises just from translation fees. This has created a situation in which the cost of a European Patent is 10 times greater than one in the USA, where the average cost is Ђ1850 (ref: Croner-i International Trade)
Because of the expense, most EU inventors only patent their invention in a very limited number of Member States (on average only 5 of the 27) so the system is both costly and inefficient and clearly has an impact on the Union's competitiveness. This is particularly the case in vital sectors where research and development (R&D) is crucial, such as pharmaceuticals, nanotechnology and the bio industries.
The European Union has been working on the creation of an EU patent for many years. The latest approach - "enhanced co-operation" - aims at establishing unitary patent protection for the territories of the 25 EU member states currently taking part in this scheme. The European Commission's goal is for the first unitary patents to be granted in 2013.
