Non European 'dot com' websites can be affected by the EU Herbal Directive

If a non European company selling herbal products:

  • has a 'dot com' domain name,
  • does not have a presence in Europe/UK, and
  • does not actively market their products in Europe/UK

 

then they will not be affected by the EU Herbal Directive which came into full force on 1st May 2011.

 

If, however, the non European company has affiliates with 'dot UK' domain names (or other European domain names) which link to the non European company's 'dot com' website this is deemed to be actively marketing in Europe and therefore, their herbal products will be subject to the EU Herbal Directive.
